Welcome to Bohemian Hearts Club. The terms "we," "us," and "our" refer to Bohemian Hearts Club. We operate this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the "Services"). Bohemian Hearts Club is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (the "Terms"), together with any policies referenced within them, describe your rights and responsibilities when using the Services. Please read them carefully – they contain important information about your legal rights, including warranty limitations and liability.
By visiting, interacting with, or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use or access the Services.

By agreeing to these Terms, you confirm that you are at least the age of majority in your country of residence, and that you have given consent for any minor dependents to use the Services on devices you own or manage.
To use the Services – including browsing our store or making a purchase – you may be asked to provide information such as your name, email address, and billing and shipping details. Section 2 – Our Products
We have made every effort to represent our products accurately. However, colours and product appearance may vary from how they appear on your screen, depending on your device and its settings.
Many of our pieces are made with natural or semi-precious materials. These carry inherent variation in colour, texture, and pattern – no two pieces are entirely identical. Such natural variation is not a defect and does not affect the quality of the piece.
We do not warrant that the appearance or quality of any product will meet your expectations beyond what is required by applicable law. All product descriptions are subject to change at any time at our sole discretion. We reserve the right to discontinue any product and to limit quantities available to any person or region.
Section 3 – Orders
When you place an order, you are making an offer to purchase. Bohemian Hearts Club reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm acceptance and have received and processed your payment.
Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests once an order is accepted. If we decline, amend, or cancel an order, we will contact you using the details provided at the time of purchase.
Returns and exchanges are governed solely by our Returns & Refunds Policy.
You confirm that purchases are for your own personal or household use and not for commercial resale or export.
Section 4 – Prices and Billing
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price displayed at the time your order is placed, as confirmed in your order confirmation email. Unless otherwise stated, prices do not include taxes, shipping, customs, or import charges, where applicable.
You agree to provide accurate and complete payment information for all purchases. You confirm that you are authorised to use the payment method provided, and that charges will be honoured by your payment provider.
Where we run promotions with separate terms, those terms will govern in the event of any conflict with these Terms.
Section 5 – Shipping and Delivery
All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or circumstances outside our control.
Where we arrange shipping on your behalf – as is standard for purchases made through the Services – risk of loss or damage remains with us until your order is delivered to you, in accordance with the Consumer Rights Act 2015. If you arrange your own shipping or collection, risk passes at the point of handover to your chosen carrier.
Section 6 – Intellectual Property
The Services, including all text, images, graphics, product photography, video, audio, trademarks, and the design and arrangement thereof, are owned by Bohemian Hearts Club or its licensors and are protected by applicable intellectual property law.
These Terms permit you to use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, publicly display, republish, or transmit any material from the Services without our prior written consent. All rights not expressly granted are reserved.
Bohemian Hearts Club's name, logo, and related marks are our trademarks and may not be used without prior written permission. Shopify's name and marks are the property of Shopify Inc.

We may provide access to third-party tools as part of the Services. These are provided "as is" and "as available," without warranties of any kind. We have no control over such tools and accept no liability arising from their use. Use of any optional third-party tools is entirely at your own risk.

If you choose to leave the Services to access third-party content, you do so at your own risk. Any concerns about third-party products or services should be directed to the relevant third party.
Section 9 – Relationship with Shopify
Bohemian Hearts Club is powered by Shopify, which enables us to provide the Services to you. All sales and purchases are made directly with Bohemian Hearts Club. Shopify is not responsible for any aspect of transactions between you and Bohemian Hearts Club, including any injury, damage, or loss arising from purchased products or services. By using the Services, you expressly release Shopify and its affiliates from all claims arising from your transactions with us.

We may terminate these Terms or your access to the Services at any time, at our sole discretion and without notice. You will remain liable for all amounts due up to the date of termination. The following sections survive termination: Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, and any provisions that by their nature should continue beyond termination.
Section 16 -- Your Statutory Rights
Nothing in these Terms affects your statutory rights as a consumer under applicable law. Under the Consumer Rights Act 2015, goods sold to consumers in the UK must be of satisfactory quality, fit for purpose, and as described. These rights cannot be excluded or limited. If you are a consumer based in the UK or EU, you may have additional rights under local consumer protection legislation.
The disclaimers in these Terms apply to the fullest extent permitted by law, but do not override any rights you have under applicable consumer law.
Section 17 – Limitation of Liability
To the fullest extent permitted by applicable law, Bohemian Hearts Club, its partners, affiliates, agents, and service providers shall not be liable for any indirect, incidental, punitive, special, or consequential damages – including lost profits, lost revenue, or loss of data – arising from your use of the Services or any products purchased through them, even if we have been advised of the possibility of such damages.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy and Returns & Refunds Policy, constitute the entire agreement between you and Bohemian Hearts Club regarding your use of the Services.

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer or assign our rights and obligations without notice to you.
Section 22 – Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. You and Bohemian Hearts Club agree to submit to the exclusive jurisdiction of the courts of England and Wales in respect of any dispute arising under or in connection with these Terms, without prejudice to any mandatory consumer protection rights you may have under the law of your country of residence.
